1. Acceptance of Terms

By accessing or using DefaktoPay services, including our virtual and physical crypto debit cards, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2. Eligibility

You must be at least 18 years of age to use DefaktoPay. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3. Services

DefaktoPay provides cryptocurrency-funded debit cards that allow users to deposit supported cryptocurrencies and spend them as fiat currency at merchants worldwide. Our services include:

  • Virtual debit cards for online transactions
  • Physical debit cards for in-store and ATM use
  • Cryptocurrency deposit and conversion services
  • Apple Pay and Google Pay integration

4. Fees and Pricing

For a one-time fee of $111 USD, users receive both a virtual and physical card. The card includes a $1.11/month service fee. Deposit fees are 1.11%, transaction fees are 1.11%, and ATM withdrawal fees are 1.11%. DefaktoPay reserves the right to modify pricing with reasonable advance notice.

5. Supported Cryptocurrencies

DefaktoPay currently supports deposits in Bitcoin (BTC), Ethereum (ETH), Solana (SOL), BNB, Tether (USDT), USD Coin (USDC), and Monero (XMR). The list of supported cryptocurrencies may change at our discretion.

6. User Responsibilities

You are responsible for:

  • Ensuring all cryptocurrency deposits are from lawful sources
  • Maintaining the security of your account credentials
  • Complying with all applicable laws in your jurisdiction
  • Any transactions made using your DefaktoPay card

7. Prohibited Uses

You may not use DefaktoPay services for:

  • Any illegal activities or transactions
  • Money laundering or terrorist financing
  • Fraud or deceptive practices
  • Circumventing sanctions or trade restrictions

8. Limitation of Liability

DefaktoPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the card in the twelve months preceding the claim.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will make reasonable efforts to notify users of significant changes.

10. Termination

DefaktoPay may terminate or suspend your access to services immediately, without prior notice, for conduct that we determine violates these Terms of Service or is harmful to other users or to DefaktoPay.
